Terms of Service

Welcome to Under Construction Technologies. These Terms of Service explain how we provide website hosting, email hosting, domain management, and website development. By using our services, you agree to the terms below.
1. Our Services
We provide:
- Website Hosting – reliable hosting through trusted third-party providers.
- Email Hosting – secure email accounts with custom domains. Includes 3GB storage per mailbox, with additional storage billed separately.
- Domain Management – registration, renewal, and DNS management.
- Website Development – custom website design, development, and updates billed hourly.
2. Pricing
Our fees are outlined on our Pricing Page.
- Invoices are issued monthly or annually depending on the plan selected.
- Monthly & Yearly hosting fees are paid via PayStack subscription.
- Domain renewal fees are billed once a year in February for all active domains.
- Email hosting includes 3GB storage per mailbox. Additional storage beyond 3GB is billed at R5 per GB per month.
- If you are hosting a Basic Website together with Basic or Team Email Hosting, your total fee will be that of the email hosting plan only.
- Payments are due within 7 days of invoice date unless otherwise specified..
2.1 Grace Periods & Late Payments
- If payment is not received within 7 days, services may be suspended automatically.
- Accounts that remain unpaid for more than 30 days may be terminated, and all associated data may be deleted.
- Reconnection fees may apply after suspension.
2.2 Annual Review
Pricing is reviewed annually and may be adjusted with 30 days’ written notice.
2.3 Chargebacks & Disputes
Clients agree to contact us before initiating a chargeback or Paystack dispute.
Initiating a chargeback without prior communication may result in:
- Immediate service suspension
- Termination of services
- Recovery action for associated fees
3. Service Availability
- Hosting uptime and email delivery are subject to our third-party providers.
- While we strive for maximum reliability, we do not guarantee 100% uptime.
- Planned maintenance and unavoidable downtime will be communicated where possible.
4. Your Responsibilities
By using our services, you agree to:
- Use services for lawful purposes only
- Keep your account credentials secure
- Maintain backups of your website and email data
- Ensure all website and email content complies with applicable laws
5. Data & Backups
- We take reasonable steps to safeguard your data.
- However, you are responsible for maintaining your own backups.
- We are not responsible for data loss caused by third-party failures, or misuse.
6. Limitation of Liability
We will not be liable for:
- Indirect or consequential losses (such as lost profits or data)
- Downtime or issues caused by third-party providers
- Client misuse of services or unlawful activity
Our total liability is limited to the fees you have paid to us in the past 12 months.
7. Termination
- You may cancel services at any time with 30 days’ notice before the next billing cycle.
- Domain renewals cannot be canceled once processed.
- We may suspend or terminate services immediately if:
- Payments are overdue
- Services are misused
- These Terms are breached
8. Data Retention & Privacy
We process and store client data in accordance with the Protection of Personal Information Act (POPIA) and, where applicable, the General Data Protection Regulation (GDPR).
8.1 Data Retention After Termination
Upon termination or cancellation of any service:
- Website files, email data, and related content may be retained for up to 14 days for recovery purposes.
- During this retention period, data restoration may be requested and may be subject to an administration or recovery fee.
- After 14 days, all data will be permanently deleted and cannot be recovered.
- We are not obligated to retain backups beyond this period unless a backup service has been explicitly purchased.
Clients are responsible for downloading and backing up all data prior to termination.
8.2 Lawful Processing
Client data is processed only for the purpose of providing contracted services, including hosting, email delivery, billing, and support.
8.3 Third-Party Providers
Hosting, email, and domain services are delivered using trusted third-party providers. Client data may be stored and processed on their infrastructure in accordance with their security and privacy standards.
8.4 Client Rights
Clients have the right to:
- Request access to their personal data
- Request correction or deletion of personal data (where legally permitted)
- Object to unlawful processing of personal data

8.5 Outstanding Payments
If services are suspended or terminated due to non-payment, data retention periods may be reduced or waived entirely.
9. Support Scope
We provide standard support for:
- Email account setup and troubleshooting
- DNS configuration for domains we manage
- General hosting inquiries
Support does not include:
- Third-party software or device troubleshooting
- Website design, development, or complex migrations (these are billed hourly under development services)
10. Liability
- We are not liable for any indirect, incidental, or consequential damages caused by service use or downtime.
- Our total liability for any claim is limited to the amount paid for the service in the last 30 days.
